Contract Conclusion

The information provided to the traveler before the contract is concluded is part of the package travel contract and cannot be altered unless the parties agree otherwise.

The Directive specifies certain components that must be included in the contract:

  • The traveler’s special requests that the traveler has agreed to;
  • Information that the organizer is responsible for the proper provision of all travel services included in the contract and that the organizer is obliged to assist the traveler if they face difficulties;
  • The name of the institution responsible for insolvency protection;
  • Contact information that allows the traveler to quickly and effectively communicate with the organizer;
  • Information that the traveler must notify of any non-conformity encountered during the trip;
  • Information about available complaint procedures;
  • Information about the traveler’s right to transfer the contract to another traveler;
  • If minors are traveling without a parent or guardian – information that allows direct communication with the minor or the person responsible for the minor’s welfare at their place of stay.

The organizer or retailer provides the traveler with a copy of the contract or its confirmation on a durable medium. The traveler has the right to request a paper copy if the package travel contract is concluded while the parties are simultaneously present.

In the case of a “Click-through” service, the retailer, to whom the data is sent, informs the organizer about the conclusion of the contract, resulting in the creation of a package travel service. The retailer provides the organizer with the necessary information for the organizer to fulfill their obligations.

Once the organizer has received the information that a package travel service has been created, the organizer sends the traveler the confirmation of the package travel contract.
